Welcome to Kids Animation AI. These Terms of Service ("Terms") constitute a legally binding agreement between you, as the user, and Kids Animation AI ("Company," "we," "us," or "our"), governing your access to and use of the website kidsanimationai.com and all associated services, features, and content (collectively, the "Service").
Please review these Terms carefully before utilizing the Service. Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. By accessing or using any part of the Service, you signify your unequivocal agreement to be bound by these Terms. If you do not agree with any provision of these Terms, you are expressly prohibited from using or accessing the Service.
1. Agreement to Terms and Amendments
1.1. Acceptance of Terms: By establishing an account, accessing, or employing the Service, you represent and warrant that you are at least eighteen (18) years of age, or if a minor, that you have obtained verifiable parental or guardian consent to use the Service and that such parent or guardian agrees to be bound by these Terms on your behalf. You acknowledge your understanding and acceptance of these Terms, as well as our Privacy Policy.
1.2. Amendments: Kids Animation AI reserves the unequivocal right, at its sole discretion, to modify or replace these Terms at any time. Should a revision be material, we shall endeavor to provide at least thirty (30) days' notice prior to any new terms taking effect. What constitutes a material change shall be determined at our sole discretion. Your continued use of the Service subsequent to the effectiveness of any such revisions shall constitute your acceptance of the revised Terms.
2. Description of Service
Kids Animation AI provides an online platform leveraging artificial intelligence technologies to enable users, predominantly children under parental or guardian supervision, to create animated content ("User Content"). Our objective is to foster creativity and provide an engaging, safe environment for digital animation creation.
3. User Accounts and Responsibilities
3.1. Account Creation: To access certain features of the Service, you may be required to register for an account. You covenant that all information provided during registration shall be accurate, complete, and current. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that transpire under your account.
3.2. Security: You shall promptly notify Kids Animation AI of any unauthorized use of your account or any other breach of security. Kids Animation AI shall not be liable for any loss or damage arising from your failure to comply with this Section 3.2.
4. Acceptable Use Policy
4.1. Prohibited Conduct: You hereby covenant not to utilize the Service for any purpose that is unlawful or prohibited by these Terms. Specifically, and without limitation, you shall not: a. Upload, post, or transmit any User Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable. b. Engage in any conduct that could damage, disable, overburden, or impair the Service or interfere with any other party's use and enjoyment of the Service. c. Attempt to gain unauthorized access to any accounts, computer systems, or networks connected to the Service through hacking, password mining, or any other illicit means. d. Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity. e. Use the Service to solicit personal information from minors.
4.2. Compliance with Laws: You shall adhere to all applicable local, state, national, and international laws and regulations in connection with your use of the Service.
5. Intellectual Property Rights
5.1. Company Intellectual Property: All content, features, and functionality within the Service, including but not limited to, software, design, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, and video, are and shall remain the exclusive property of Kids Animation AI and its licensors. These Terms do not grant you any right or license to use any of Kids Animation AI's intellectual property.
5.2. User-Generated Content: You retain all ownership rights in the User Content you create, upload, or submit through the Service. By submitting User Content, you grant Kids Animation AI a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the operation of the Service and Kids Animation AI's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish User Content you submit.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. KIDS ANIMATION AI EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. KIDS ANIMATION AI MAKES NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT THE RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KIDS ANIMATION AI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE, EVEN IF KIDS ANIMATION AI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. KIDS ANIMATION AI'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE, REGARDLESS OF THE FORM OF ACTION, SHALL IN NO EVENT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO KIDS ANIMATION AI FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
8. Indemnification
You hereby agree to indemnify, defend, and hold harmless Kids Animation AI, its parents, subsidiaries, affiliates, officers, directors, employees, consultants, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your (or anyone using your account's) violation of these Terms or any applicable law or regulation, or your breach of any representation or warranty made by you herein.
9. Termination
Kids Animation AI may, in its sole discretion, suspend or terminate your account and access to the Service, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, intellectual property ownership, warranty disclaimers, indemnity, and limitations of liability.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction where Kids Animation AI is incorporated, without regard to its conflict of law provisions.
11. General Provisions
11.1. Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Kids Animation AI pertaining to your use of the Service and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Kids Animation AI.
11.2. Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.
11.3. No Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Kids Animation AI's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
11.4. Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Kids Animation AI may assign its rights and obligations under these Terms without restriction.
